“When False Allegations Collide with the Truth: My Experience Fighting a Misconduct Restraining Order”
Recently, I went through one of the most stressful — and eye‑opening — experiences. Someone filed a Misconduct Restraining Order (MRO) application against me filled with allegations that were completely untrue.
In the end, the application was withdrawn by the applicant before it even went to a hearing. On paper, I “won.” But the experience revealed how damaging false claims can be, and how easily people assume “where there’s smoke, there’s fire” — even when the only smoke is the kind being blown from someone else’s story.
Facing False Allegations
When the application landed in my hands, it was full of allegations that never happened. Despite this, when we appeared before the magistrate, I could feel that she had some preconceived ideas about me.
I agreed — voluntarily and not legally binding — to avoid any of the conduct alleged in the application (because I hadn’t done it anyway). But I also refused to sit silently while I was being spoken down to. I requested that I appear by video link, but still, that tension played out while the applicant was in the courtroom and, yes, I spoke over the magistrate a few times. She was clearly unhappy about it. But I stood my ground because truth matters. The applicant had to hear those words ‘perjury’, her ‘stalking’ behaviour, and ‘criminal offence’.
I did have the right to not accept the applicant withdrawing the application, therefore I would not have been to required to voluntarily agree to anything, but for future reference, it actually works in my favour by ‘agreeing’. The applicant did herself no favours by withdrawing the application, but HAD to, to avoid committing perjury.
The Power of Documentation
If this person decides to file another MRO with even more lies, I’m ready. I’ve kept the original application (laminated, no less) and I will present it as evidence if necessary.
Perjury isn’t just a word — it’s a real crime. And I have evidence. Right now, I have over 53GB of home security footage — with audio — documenting everything from cars passing by, to people approaching my property, to individuals looking through my windows. It’s creepy, but the applicant created the need for me to do this, so it’s also proof. Each video is around 2MB in size, equating to around 26,000+ videos at time of writing.
If anyone tries to fabricate events again, they’ll be facing my evidence and, if appropriate, I’ll push for perjury charges through the proper channels.

I’ve shared some of the footage with others in the area I live. People have seen for themselves what’s really been happening. Their reactions have been telling: words like “stalker,” “coward,” and “weirdo” have been used about the applicant, by others — not me.
Unfortunately, some people don’t care what others think and will continue with this kind of behavior regardless. That’s why protecting yourself with evidence, staying calm, and knowing your rights is critical.

This experience taught me a few key lessons:

False allegations can happen to anyone. But preparation, documentation, and a calm, evidence‑based response can make all the difference.

Your Honour,
From the outset of this matter, the behaviour of the applicant has been troubling, persistent, and deeply intrusive. What began as seemingly friendly gestures quickly escalated into conduct that I can only describe as harassment and stalking, leaving both myself and my partner feeling unsafe, anxious, and constantly monitored in our own home.
Since moving into the rental property next to me (we own our property), in late 2023, the applicant repeatedly inserted herself into our lives. She would knock on our door at all hours—including late at night—ring the doorbell so frequently that I was forced to remove its batteries, she would intercept us whenever we stepped outside, whether to collect the mail or put out rubbish. Despite being asked politely to respect our boundaries, her conduct persisted.
The applicant went further by throwing dog treats over my fence after I had specifically asked her not to. When confronted, she reacted with offence rather than compliance. She would also bring unsolicited food to our door, knock at inappropriate times, and even contact my partner directly with accusations against me—claims that I was yelling at my dogs or cat, or behaving aggressively—attempting to undermine me in my own household. This was not only offensive but a clear attempt to sow discord and portray me as unstable.
More concerning still, the applicant engaged in stalking behaviour. She would appear outside within minutes of us stepping into either the front or back yard, it was as though she was monitoring our every move. On multiple occasions, she was caught standing on a chair or ladder at the fence line, peering directly into our home, sometimes with a vacant stare, before pretending to adjust fairy lights when she realised she had been seen. This was not an isolated incident but a repeated pattern of behaviour.
The applicant has also fabricated interactions. On one occasion, she told my partner that she and I had been enjoying conversations on Facebook, despite the fact that I had permanently deleted my Facebook account nearly a year earlier while recovering from bowel cancer surgery. This lie was so blatant that I immediately secured my other social media accounts, recognising the risk of impersonation or further stalking.
Her actions have extended into interference with my property and finances. Delivery vehicles, visiting solely to serve the applicant, have repeatedly used my verge and blocked access to my driveway, despite my repeated requests for her to instruct them otherwise. This has caused damage to my reticulation system on two occasions, costing me hundreds of dollars in repairs, as well as deterioration to my driveway pavers. Despite assurances, the applicant never acted to prevent this. Eventually, I was forced to erect star pickets and wire at my own expense to protect my property.
The situation has placed further strain on my health. I have endured bowel cancer surgery, collapsed on my driveway October 2024 believed to be my first mini stroke, suffered a mini stroke on September 3, 2025, and continue to deal with significant medical issues involving my neck spine, causing nerve compression down my left arm, hand and fingers. The constant stress and harassment have only compounded these conditions, causing severe anxiety, depression, and a repeated hospital admission on September 16, after suffering chest pains, sweating and being light headed. My partner, who already shoulders the trauma of losing her daughter-in-law in March 2024, and is caring for her grieving son and grandchildren, has also been subjected to this stress.
Your Honour, this application is not made from a place of genuine fear by the applicant, but rather as a continuation of a pattern of harassment, manipulation, and gaslighting. The applicant has made false and exaggerated claims, presented out-of-context allegations, and misrepresented interactions in an attempt to tarnish my reputation and character. The truth is that I have never been the aggressor. I have only ever sought to protect my home, my partner, pets, and my own well-being.
The police themselves, when called to attend after a request from the applicant, confirmed that they saw through the applicant’s behaviour. They assured me I had nothing to worry about and recognised that her allegations lacked credibility. Since installing cameras for my own protection, I have been able to provide video evidence that contradicts her claims and demonstrates that she moves freely and without fear around her property—even when I am outside at the same time. This is not consistent with someone genuinely in need of protection.
Your Honour, I respectfully submit that this application is not a matter of protection for the applicant, safety or justice, rather I am the person in need of protection from the applicants’ unusual and stalking behaviour. It is an abuse of process, built on lies and exaggerations, and has already wasted police and court resources. More importantly, it has caused me real harm—emotional, financial, and physical. I should not have to live in fear of false accusations, nor should I be forced to defend myself against fabrications designed to intimidate and control, although I will.
I ask that the Court carefully consider the evidence I have provided: the videos, the photographs, the text messages, and the testimony of police officers who saw through the applicant’s deception and lies. I further ask that weight be given to the clear and ongoing pattern of stalking, harassment, and boundary violations I have endured.
The applicant has lied in her application for a misconduct restraining order. I respectfully request that this matter proceed to a full hearing, as it is important that the applicant understands there are consequences for making false statements before this Court.
If the applicant chooses to withdraw her application, that does not erase the seriousness of what has already been done. False allegations are damaging, and when proven, they should not be excused without accountability. The applicant must also recognise that involving other people by asking them to lie on her behalf only places those individuals at risk of legal repercussions should the evidence show they also have been untruthful.
This Court is a place for truth, it should not be reduced to a contest of “he said, she said.” Matters of this seriousness must be evidence-based, and I am prepared to present evidence to show the truth of what has occurred.
For these reasons, Your Honour, I ask that this matter be heard in full, so that the applicant’s conduct can be properly examined and the truth established.
In conclusion, Your Honour, I do not seek to inflame matters, but I will not bow to lies. I want only to live in peace, to safeguard my health, and to be free from this persistent harassment.
